Apple's $1B Patent Award From Samsung Gets Cut By $450M

She also said Samsung deserves a new trial over claims related to some of its smartphones. "Koh rejected Apple’s request to enhance the jury’s award, saying the amount Samsung owed was heavily disputed and the jury wasn’t bound to accept either side’s damages estimate. 'It is not the proper role of the court to second-guess the jury’s factual determination as to the proper amount of compensation,' Koh said in her ruling. Apple is entitled to additional damages for sales of infringing products that weren’t considered by the jury, Koh ruled, saying she intends to calculate the amount beginning on Aug. 25, the day after the jury reached its verdict. As the case has been appealed, Koh said she would delay considering evidence of actual post-verdict sales and pre-judgment interest until the appeals are completed." ...

Apple's landmark $1 billion damages award over Samsung has been partially vacated by presiding judge Lucy Koh, FOSS Patents reports. The judge has orders just north of $450 million be struck from the $1 billion total, an amount which relates to 14 Samsung products involved in the case, pending a new trial to determine appropriate damages for those specific devices.

Apple Claims Ignorance of Jury Foreman's Previous Tangle With Samsung
quantr writes with the news that Apple claims that the company "wasn't aware during trial that the foreman of the jury that issued a $1.05 billion verdict against Samsung Electronics Co. was involved in a lawsuit with his former employer, Seagate Technology Inc. 'Samsung asked Apple to disclose when it first learned about the litigation between the jury foreman, Velvin Hogan, and Seagate. Apple responded in a filing yesterday in federal court in San Jose, California. Samsung is attempting to get the Aug. 24 verdict thrown out based on claims the trial was tainted by the foreman's failure during jury selection to tell U.S. District Judge Lucy H. Koh, who presided over the case, that he filed for bankruptcy in 1993 and was sued by Seagate."

Apple trial in San Jose, and Judge Lucy Koh opened the day with a joke, saying that there had been a false hope in her heart this weekend that the two would settle. But these two electronics giants are still ready to battle it out, and have brought Justin Denison, Samsung's Chief Strategy officer, back to the stand. After some questions about whether or not STA sells directly to consumers, and whether or not Galaxy phones are different from one model to the next, Samsung's lawyer Mr. Quinn was about to actually make a point. He mentioned that throughout the trial, there have been comments such as "Samsung is in a crisis of design" and "the difference between the iPhone and the Galaxy phones are like heaven and earth."
